You know you’re embroiled in a heated lawsuit, when the Equal Employment Opportunity Commission picks a battle with you. This unfortunate occurrence seems to be the case with two Nevada businesses – Health Center Inc. and Ultracare Las Vegas – with the EEOC claiming they violated federal law when they got rid of an ultrasound technician because he’s a man.
“We see sex discrimination occurring in all types of workplaces, and employers need to realize that EEOC is fully committed to eradicating this form of unlawful conduct against anyone,” said Las Vegas’ EEOC Director Richard Burgamy in a statement.
Details and Allegations of the Sex Discrimination Lawsuit
The following details were either part of court filed documents or local media reports:1
- The lawsuit was filed on Thursday, June 23 and names both the Health Center Inc. and Ultracare Las Vegas.
- Nevada Health claims on its website that it is a non-profit organization that provides services to 50,000 individuals every year.
- According to the complaint filed, Ultracare hired the male ultrasound technician full-time on Nov. 9, 2012. His responsibilities were to work for Nevada Health part-time as part of his contract.
- According to the contract, Ultracare contracted out ultrasound technicians to Nevada Health facilities.
- The man’s work responsibilities included performing transvaginal ultrasounds.
- When he was required to perform transvaginal ultrasounds, Nevada Health also sent along a female attendant as a chaperone, according to court documents.
- In December 2012, Nevada Health stopped providing the female chaperone.
- Nevada Health then requested that Ultracare provide a female chaperone or a female ultrasound technician.
- As a result of the new request, Ultracare reassigned a female to Nevada Health.
- The man’s last known assignment at Nevada Health was approximately Jan. 4, 2013.
- Ultracare and Nevada Health’s conduct violates prohibitions against sex discrimination under Title VII of the Civil Rights Act of 1964, according to the EEOC.
- After attempting to settle the dispute through mediations, the EEOC filed a lawsuit against both Ultracare and Nevada Health.
