LA Rental Car Company Settles EEOC Age Discrimination Suit for $425,000

Enterprise Rent-A-Car Company of Los Angeles, LLC has agreed to pay a $425,000 settlement to resolve an age discrimination case brought against it by the U.S. Equal Employment Opportunity Commission (EEOC).

Announcing this settlement, the EEOC explained that the initial age discrimination charges had been filed against the company for its discriminatory practices related to hiring employees for management trainee positions. Specifically, an EEOC investigation found that, between 2008 and 2011, the rental company had denied 10 job applicants who were 40 or older entrance into this program due to their age and, instead, had hired “less qualified, younger applicants, a violation of the Age Discrimination in Employment Act (ADEA).”

Additionally, the EEOC found that:

  • Over the three-year period, no applicants over 40 were hired into the company’s management trainee program at the Burbank office.
  • This office had failed to “adequately maintain application records pursuant to federal law.”

A Look at the Settlement Agreement with Enterprise

In an effort to settle this case and “avoid the time, effort and expense associated with further proceedings,” Enterprise of Los Angeles, LLC has agreed to the settlement payment, as well as to:

  • Provide EEO training to all staff, with a specific emphasis on age discrimination
  • Distribute its anti-discrimination policy to all of its Los Angeles-area employees
  • Maintain a compliant record-keeping system
  • Allow the EEOC to monitor its compliance with this agreement over the next three years.

Commenting on this agreement, Rosa M. Viramontes, the district director of the EEOC’s LA District Office, stated:

Federal law requires that employers select the best qualified job candidates regardless of age… we are pleased that the local Enterprise Rent-A-Car office agreed to adopt measures to ensure that older job applicants enjoy equal employment opportunities going forward.
